Employers in Indiana are increasingly vulnerable to lawsuits as clever attorneys interpret state laws.
Greedy lawyers and disgruntled employees are using Indiana's pro-employee laws to blast employers with more “sue power” than federal laws. Indiana jurors are famously generous to fired employees. And Indiana lawyers are notorious for using state laws to sue employers in all kinds of creative ways – even if the employer complies perfectly with federal law.
- Have an employee who slipped and fell in the parking lot on the last icy morning? Under the Indiana Workers’ Compensation Law, employers are held accountable for a variety of workplace injuries: for instance, those that occur in common areas, such as parking lots, driveways and entrance roads.
- Is one of your workers filing a discrimination claim under the Indiana Civil Rights Act? If the case goes to state court, the types of damages are limited, but there’s no cap on the dollar amount.
- Are you hiring foreign workers for specific temporary jobs? If so, be prepared to jump several hurdles under the Indiana Temporary Foreign Labor Certification Act, such as showing that no qualified American workers are available for the position.
Unlike federal lawsuits, the sky’s the limit on state-court damages. Plus, even if you win a lawsuit, legal fees could still run you $10,000 or more. You can’t be too prepared.
