Public employees must gripe to OAH before going to EEOC

If you are a state or local government employer, here’s a tip that may prompt a judge to dismiss an employee’s dis­­­­crimination claim early on: Public employees have to first file a discrimination claim with the state Office of Administrative Hearings (OAH) before going to the EEOC.

Altering employee’s schedule? Be sure to document your reasons for making the change

There are plenty of good reasons why you might have to change an employee’s schedule. Don’t get sloppy about how you implement the change. Make sure you document exactly why you are rejiggering the usual schedule.

Proceed with layoff if employee you planned to cut suddenly complains about discrimination

When employees hear rumors that business is down, they often worry that jobs will be cut. One trick they sometimes use is to rattle a few chains and start complaining about discrimination. Don’t let that interfere with plans already in place for a layoff or other workplace changes that you know aren’t related to discrimination. Just make sure you have adequate documentation to explain when the layoff decision was made and why.

E-Verify to be mandatory for many N.C. employers

On June 23, Gov. Bev Perdue signed legislation that requires private em­­ployers with at least 25 employees and all county and city governments to use the federal government’s online E-Verify system to verify that new hires are eligible to work in the United States.

Settlement may mean higher pay for pharma firm’s N.C. women

Pharmaceutical giant Astra Zeneca has agreed to settle a gender pay bias claim, and the consent decree that spells out the terms of the settlement could affect North Carolina women who work for the company. Under the settlement, 124 female pharmaceutical sales specialists will split $250,000.

Feds issue new tip-credit pooling rules

Employers are now free to set the percentage of employee tips that can be placed in a tip pool. In years past, several court decisions conflicted with the U.S. Department of Labor’s position restricting the amount of tips an employer could require to be pooled.

No self-defamation claim possible in North Carolina

A former employee at a North Carolina Walmart has lost a novel claim that could have opened the litigation floodgates in North Carolina and destroyed the at-will employment concept. He sued, alleging he had been forced to reveal why he had been fired, which in effect amounted to self-defamation.
