Q. I read the article last month (“Follow 5 steps to make sure GINA doesn’t trip you up”) regarding the recent passage of the Genetic Information Nondiscrimination Act. What should we do to make sure that we are not violating this law?

Q. We have a number of Spanish-speaking employees. We can’t tell, but we suspect they sometimes make inappropriate comments in Spanish about our clients and other employees. Can we require these employees to speak only English when at work?

Q. Our break/locker room is located upstairs. We have several employees (age 66 to 77) who are having trouble climbing the steep stairs due to advancing age. We’re afraid they’ll fall. They all say they’d crawl up the stairs before they quit.

How should we handle mandatory overtime when determining FMLA leave hours?

Q. Can an employer deduct or count overtime hours from an employee’s FMLA balance? Our employees work overtime only from October through December. During that time, they’re required to work 12-hour days, seven days a week. We have several employees on both continuous FMLA and intermittent leave, and we’d like to deduct the overtime hours they would have worked from their FMLA allotment. What do you think?

Do we have to pay bonuses to employees who quit before the normal payout date?

Q. Our company pays out bonuses in the year after the work is completed, sometimes late into the first quarter. If an employee resigns before the bonus payout date (say, in February), do we have to pay a bonus to that employee?

What are the notice requirements when moving someone from exempt to nonexempt?

Q. We’re planning to demote an employee for performance reasons. He’d move from a supervisory job (salaried/exempt) to an hourly job, so we would cut his pay by about $10,000 a year. What kind of notice must we give him regarding the pay cut and exemption status?

Will our name on consultant’s business cards affect his independent contractor status?

Q. One of our former employees, Joe Smith, has started an engineering consulting business. We have contracted with Joe to provide services similar to those he provided when employed. Would providing him with business cards bearing our name and logo jeopardize his independent contractor status?

Is it legal in North Carolina to withhold bonuses not paid at the time of termination?
